Terms of Service

Acceptance of Terms

By accessing or using the Kayden Connect platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service.

Account Terms

  • You must be at least 18 years old to use the Service
  • You must provide accurate, complete, and current registration information
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • One person or legal entity may not maintain more than one free trial
  • The Tenant Administrator is responsible for all activity within their workspace

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload or transmit malicious code, viruses, or harmful content
  • Harass, bully, intimidate, or discriminate against any person
  • Send unsolicited commercial messages (spam)
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape, crawl, or use automated means to access the Service without permission
  • Upload content that infringes intellectual property rights

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account.

Billing & Payments

  • All plans require a valid credit card on file
  • The 14-day trial is free; your card is charged at the end of the trial period
  • Subscriptions are billed monthly or annually depending on your selected plan
  • HQ plans require annual billing only
  • Prices are in USD unless you select ZAR (PPP) pricing
  • You may upgrade, downgrade, or cancel your subscription at any time
  • Downgrades take effect at the end of the current billing period
  • Refunds are not provided for partial billing periods
  • Failed payments will trigger a 14-day grace period before account restriction

Intellectual Property

The Service, including all software, designs, text, graphics, and other materials, is owned by Kayden Connect LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

The Kayden Connect name, logo, and all related marks are trademarks of Kayden Connect LLC.

Data Ownership

You retain all rights to the content you create and upload to the Service (“Your Content”). We do not claim ownership of Your Content.

You grant us a limited license to host, store, and display Your Content solely to provide the Service. This license terminates when you delete Your Content or close your account.

Upon account termination, you may export Your Content within a 30-day grace period. After the grace period, Your Content will be permanently deleted.

Limitation of Liability

To the maximum extent permitted by law, Kayden Connect LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the billing settings in your account. We may suspend or terminate your access if you violate these Terms.

Upon termination, your right to use the Service ceases immediately. We will retain Your Content for 30 days to allow data export, after which it will be permanently deleted.

Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wyoming.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
